Terms & Conditions of Use
All bella|faith design services are subject to the following terms and conditions of use. If you have any problems understanding a condition, please contact us for clarification. However, if you do not agree with a condition, do not contact us or purchase one of our services. Purchase of any service from bella|faith design signifies your complete agreement to the following terms and conditions of use.Copyright: bella|faith design retains the right to use any preliminary or completed designs for the purpose of marketing materials, portfolio, design competitions, design publications, and educational purposes. bella|faith design owns the finished assembled work of all XHTML & CSS provided by bella|faith design. No graphics, XHTML, nor CSS may be altered, reused, sold, shared or distributed in any way without written consent from bella|faith design. All bella|faith design copyrights & credits must remain intact & visible. Unless you have written consent from bella|faith design the link back to bellafaithdesign.com must remain in place & in working order.
Copyrights and Trademarks of Client Provided Elements: All images, text & products provided by the client must be owned by the client (the client must either be the creator of these elements or have written authorization to use the elements). The client is responsible for any elements provided & used by the client, and agrees to pay any and all legal expenses incurred from lawsuits against bella|faith design for those elements. bella|faith design will not be held liable for client provided elements.
Privacy Policy: All transactions between bella|faith design and the client are treated as confidential. bella|faith design will not share any information provided by the client to any third parties.
Payment: All templates must be paid in full at time of purchase.
Refund: Client may request a refund before installation of the template on the client's site. However, a fee for work completed (any expenses incurred & an hourly rate of $40.00 for customizing the site) will be retained by bella|faith design.
Copyright: The template & graphics provided by bella|faith design may be used on one site only, unless you have written consent from bella|faith design.
Quotes: bella|faith design honors quotes for 30 days.
Contracts: Contracts must be signed by the client & returned to bella|faith design within 30 days.
Waiting List: If a waiting list is in effect, a 25% deposit must be made to hold the client's place. Waiting lists are divided into months. All waiting list designs will be started by the beginning of the second week of that month.
Revisions & Hourly Rates: The amount of revisions a client is allowed depend on the service purchased. The amout of allowable revisisons will be listed in that service's description as well as the contract. If a client exceeds this number of revisions, or if no revisions are allowed, an hourly rate will be charged. Hourly rates start at $40.00.
Project Schedule/Completion: bella|faith design and the client agree to communicate & work together in a timely manner to finish the project. bella|faith design will provide the client with status updates. If the client does not contact bella|faith design for more than 14 days, without prior written notice, bella|faith design has the right to require additional payment or cancel work on a project. Complete text and graphic content for the project must be provided to bella|faith design by the client within 7 days from the requested date.
Payment Schedule & Fees: Before the second week of the waiting list month, 50% of the contract price must be paid. No designing will begin until the signed contract has been received and the 50% deposit has been made. The remaining 50% is due before installation of the website. Upon receipt of payment, the site will be installed and files delivered to the client. If a client chooses to pay by check, they agree to be fully liable, should the bank return the check for any reason, and pay a $30.00 fee in addition to any fees incurred by bella|faith design.
Hosting: Unless the purchased service & contract say otherwise, the client is responsible for registering their domain name & maintaining it and their hosting services. The client agrees that they understand their hosting plan and are responsible for any and all hosting service charges.
Copyright of Artwork: All preliminary artwork provided by bella|faith design and not chosen by the client remain the full property of bella|faith design and may be used for a future client's project. The final logo and graphic design rights are transferred to the client upon receipt of full payment and completion of the site and any print designs requested.
Support & Claims Period: The client will have 30 days after the design has been turned over to them for support and to claim any defects, damages, or shortages. After 30 days, support may be charged at hourly rates.
Refunds & Cancellations: All deposits are non-refundable. No refunds are made for graphic or web design services. A client must submit a written notice of cancellation. If the fee for any work completed and expenses incurred exceeds the client's deposit, the client agrees to pay the extra. All layout and designs remain the property of bella|faith design.
